CS FOR SENATE BILL NO. 211(RLS) was before the Senate on reconsideration. Senator Halford moved that the bill be returned to second reading for the purpose of a specific amendment, that being Amendment No. 1. Without objection, it was so ordered and the bill was returned to second reading. Senator Halford offered Amendment No. 1 : Page 1, line 1, following "assault": Insert "and sexual abuse" Page 2, following line 28: Insert new bill sections to read: 1996-04-04 Senate Journal Page 3068 SB 211 "* Sec. 3. AS 11.41.438(a) is amended to read: (a) An offender commits the crime of sexual abuse of a minor in the third degree if (1) being 16 years of age or older, the offender engages in sexual contact with a person who is 13, 14, or 15 years of age and at least three years younger than the offender; or (2) being 18 years of age or older, the offender engages in sexual penetration with a person who is 16 or 17 years of age and (A) at least three years younger than the offender, and the offender occupies a position of authority in relation to the victim; or (B) the offender is a police officer but is not a legal guardian of the victim and the offender is known to the victim as a police officer. * Sec. 4. AS11.41.440(a) is amended to read: (a) An offender commits the crime of sexual abuse of a minor in the fourth degree if (1) being under 16 years of age, the offender engages in sexual penetration or sexual contact with a person who is under 13 years of age and at least three years younger than the offender; or (2) being 18 years of age or older, the offender engages in sexual contact with a person who is 16 or 17 years of age and (A) at least three years younger than the offender, and the offender occupies a position of authority in relation to the victim; or (B) the offender is a police officer but is not a legal guardian of the victim and the offender is know to the victim as a police officer." Renumber the following bill sections accordingly. Senator Halford moved and asked unanimous consent for the adoption of Amendment No. 1.
